These Terms of Service ("Terms") govern your access to and use of the Gogu platform and services ("Services"). By accessing or using Gogu, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1.Eligibility

By using Gogu, you confirm all of the following:

• You have the legal capacity to enter into a binding agreement.
• All information you provide is accurate, current, and complete.
• You will keep your information updated where necessary.
• You have not been previously suspended or banned from Gogu.
• You will comply with all applicable laws and regulations.

Use of Gogu is prohibited where such use is unlawful.

2.Nature of the Service

Gogu provides a platform for users to store, manage, and transfer instructions relating to digital assets and wealth.

• Gogu does not provide legal, financial, or fiduciary advice.
• Gogu does not act as a trustee, executor, or custodian of your assets.
• Gogu does not access, view, or control encrypted data stored in your digital will.
• You remain fully responsible for the accuracy, legality, and enforceability of any instructions you create.

3.Account Creation and Security

3.1 Account Registration

You must create an account to access certain features. You agree to:

• Provide accurate and complete information.
• Maintain and update your details as required.

3.2 Account Security

You are responsible for:

• Safeguarding your login credentials.
• All activity under your account.

You must notify Gogu immediately of any unauthorized access or suspected breach.

Gogu is not liable for losses arising from compromised account credentials due to your failure to secure them.

4.Use of Services

4.1 License

Gogu grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

4.2 Prohibited Conduct

You agree not to:

• Violate any laws or regulations.
• Use the platform for fraudulent or unlawful purposes.
• Attempt to access other users' accounts or data.
• Interfere with system integrity, security, or performance.
• Upload or distribute malware or harmful code.
• Misrepresent identity or provide false information.
• Use the platform in a way that damages Gogu's reputation.

5.User Content and Data

5.1 Ownership

You retain ownership of all content you submit.

5.2 License to Gogu

You grant Gogu a limited license to process your non-encrypted data for:

• Operating and improving the Services.
• Customer support.
• Security and fraud prevention.

5.3 Encrypted Data

Data stored in your digital will:

• Is encrypted on your device before storage.
• Is not accessible or readable by Gogu.
• Cannot be recovered by Gogu if you lose access.

You are solely responsible for maintaining access to your encrypted data and any recovery mechanisms.

6.Intellectual Property

All rights in the Gogu platform, including software, branding, and content, belong to Gogu or its licensors.

You may not:

• Copy, modify, or distribute any part of the platform.
• Reverse engineer or attempt to extract source code.
• Use Gogu's intellectual property without written permission.

7.Third-Party Services

Gogu may integrate with third-party providers.

• Gogu is not responsible for third-party services, performance, or failures.
• Your use of third-party services is subject to their terms.

8.Limitation of Liability

To the maximum extent permitted by law:

• Gogu is not liable for indirect, incidental, or consequential damages.
• Gogu is not responsible for loss of data, including encrypted data you cannot recover.
• Gogu is not liable for failure to execute or enforce your instructions or wishes.

Your use of the platform is at your own risk.

9.Indemnification

You agree to indemnify and hold Gogu harmless from any claims, damages, or losses arising from:

• Your use of the Services.
• Your violation of these Terms.
• Your content or instructions.
• Any disputes between you and third parties, including beneficiaries.

10.SMS and Communications

10.1 Programme Description

Gogu may send SMS messages for:

• Account notifications.
• Security alerts.
• Optional marketing updates.

10.2 Opt-In

SMS is optional and not required to use Gogu.

10.3 Message Frequency

Message frequency varies based on usage. Security alerts may be sent as needed.

10.4 Message Types

• Transactional messages: account alerts, verification, security updates.
• Marketing messages: product updates and offers, only with consent.

10.5 Charges

Standard carrier rates apply.

10.6 Opt-Out

You can opt out at any time by replying STOP. Transactional messages related to security may still be sent.

11.Termination

Gogu may suspend or terminate your account if you:

• Continued use of the Services after updates means you accept the changes.

13.Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of courts in England and Wales.
